Bad Law and Bad Judges

A North Carolina judge has ruled that Alaina Giordano's estranged husband will be the primary caregiver of their children because the young mother has breast cancer. She was diagnosed in December 2007.


According to Giordano her husband moved to Chicago last year to work leaving the children with her. The couple then moved onto a messy divorce. There were allegations of abuse and cheating but it's the role of cancer that has many rallying around the mother.
The judge did say that if Giordano moves to Chicago where her husband now resides she would grant joint custody. That would make sense in other situations perhaps but Giordano's team of doctors is in Durham, North Carolina at Duke University, one of the nation's top cancer treatment centres. Making a move at this stage of her disease could be life-threatening.


Father Kane Snyder, 37, sought full custody after the break up of the couple's marriage. The Durham County Family Court judge listened to a forensic psychologist Dr. Helen Brantley in the case who said that the children should reside with their father because of the ‘deteriorating condition of the mother’s health’ reports the Daily Mail.
